Appeals

Our firm represents and advises clients who are involved in appeals. Two of the firm’s lawyers, Chris Antley and Emily Whitney, have worked as law clerks for the South Carolina Court of Appeals, gaining familiarity both with the complex procedural issues presented, and with the way in which the members of the Court evaluate appellate issues. Mr. Devlin and Mr. Parkinson have briefed and argued cases to the South Carolina Court of Appeals, the South Carolina Supreme Court, and the 4th Circuit Court of Appeals.

Business & Commercial Litigation

We provide counsel to clients in need of contract review and negotiation. Where situations have become adversarial but remain capable of being resolved without the expense of litigation, members of the firm have represented clients in contract negotiations, corporate dissolutions, and collection issues.

When litigation is unavoidable, the firm is aggressive while at the same time mindful of the client’s bottom line. The firm’s attorneys have handled cases of every size, and in practice areas as diverse as antitrust, ERISA, employment, copyright, and shareholder disputes. While the firm recognizes the utility and cost-savings which can be created by the efficient use of mediation, it does not view resolution by mediation as always being preferable to trial.

Construction Law

In commercial litigation, our firm represents parties at every level of the construction process, from owners and sureties to suppliers. We have extensive experience as well in residential construction disputes, both on behalf of owners and contractors. Prior to suit, the firm represents parties in bid protests, contract review and negotiation, and in the filing of mechanic’s liens. Mr. Devlin has obtained (and collected) judgments on mechanic’s lien claims in excess of $5,000,000.

The firm also has an active practice representing both homeowners and contractors in residential construction litigation, both on defect issues and payment claims.

Mr. Devlin has been recognized by his peers for his expertise in construction law by his inclusion in The Best Lawyers in America®, and has also been selected as a South Carolina Super Lawyer in construction litigation.

Equine Law

As an avid equestrian, Jennifer Breaux Howe brings a unique perspective and insight to your legal equine needs. She is also the only South Carolina equine lawyer to attend the National Conference on Equine Law in Lexington, Kentucky where she received 15 hours of continuing legal education credit and met with equine attorneys from across the country.

Equine law is any legal matter that involves horses in the facts. A horse lawyer can provide a large range of services including, but not limited to: personal injury, releases and waivers, sales contracts, breeding agreements, training agreements, boarding agreements, insurance, loose horse liability, easements, zoning and land use, importing and exporting, taxes, estate planning, business formation, and risk management planning.

Governmental Litigation

The firm is proud to represent governmental entities ranging in size from the small special purpose district to the State Budget and Control Board. Over the years, the firm’s attorneys have handled diverse matters for these entities, including flooding claims, professional liability, wrongful death defense, inverse condemnation, and administrative appeals.

Professional Liability Law

The majority of Mr. Parkinson’s career has been spent handling professional liability claims. His expertise has been called upon by many area hospitals and medical professionals, and his experience in this field has been the primary factor in his election to the American Board of Trial Advocates.

Real Property Issues

The firm has handled a multitude of disputes involving real property. Its members have been involved in the litigation of property line disputes, easement interpretation, road closing, zoning issues, and stormwater runoff claims. In addition, the litigation of claims arising out of the development, purchase and sale of property, whether residential or commercial, forms a steady portion of the firm’s real property practice.
